Common law

Over de aard en het ontstaan van de common law bestaan de nodige misverstanden. De geschiedenis ervan is werkelijk ingewikkeld. Recente inzichten leiden tot de hernieuwde vaststelling dat men de common law beter kan bezien in de context van de Europese rechtsgeschiedenis dan als een uniek fenomeen. Sommige aspecten en concepten laten zich echter inderdaad moeilijk vergelijken. Er is een grote continuïteit in het Engelse recht, maar er zijn ook duidelijke breuken. Veel onderwerpen vragen hier om aandacht: de rechtspraak, de rol van de staat, de betekenis van wetgeving, de rol van rechters en rechtskenners. De uitstraling van het Engelse recht in de Verenigde Staten en in vele andere landen zal elders aan de orde komen. Bij de bronnenedities gaat het in hoofdzaak om het koninklijke recht. Steden blijven grotendeels buiten beeld. Als toegift bij de selectie aan links is een sectie over Schots recht opgenomen.

Uit de Angelsaksische periode zijn met name de verschillende volksrechten bekend. Met de komst van de Normandiërs in 1066 begint een tijdvak waarin Normandische instellingen op Engelse bodem worden overgeplant en gewijzigd. De grote greep van de Normandische hertogen op hun veroveringen valt op. In de twaalfde eeuw ontstaat de common law. Koning Henry I brengt ingrijpende wetgeving en wijzigt de rechtspraak, mogelijk naar voorbeeld van de graven van Vlaanderen. De rechtspraak wordt koninklijk. Met een geschreven opdracht, de writ, begint iedere (strafrechtelijke) zaak. Het privaatrecht ontwikkelt zich ogenschijnlijk oorspronkelijk, maar in feite zijn er overeenkomsten met de casuïstiek van het Romeinse recht. Leerstukken uit het Romeinse en canonieke recht zijn terdege bekend. Juristen als Bracton en Vacarius schreven de eerste boeken over dit Engelse recht.

De Kerk leeft in Engeland als op het continent met het canonieke recht. Van de rechtspraak van Engelse officialen zijn relatief veel bronnen bewaard. Ook aan de universiteiten van Oxford en Cambridge wordt het canonieke recht onderwezen. Gewone juristen studeerden aan de Inns of Court; vier ervan bestaan nog steeds. Moots, oefendebatten, en readings (colleges) zijn bewaard gebleven. Beroemd zijn de processen in de Year Books, met snedige opmerkingen van rechters en partijen. De Year Books zijn bedoeld voor het juridisch onderwijs, niet puur als verslagen. De voertaal is tot in de 17e eeuw het Lawfrench, een mengvorm van Frans, Latijn en Engels. Er is een veelheid aan rechtbanken. De koningen vaardigden in de loop der tijden vooral statutes uit, wetten over bepaalde onderwerpen. De zittingen van het hof bij deze gelegenheden vormen het begin van het Engelse parlement. Vanaf de 15e eeuw verschijnen er meer verhandelingen over het Engelse recht. In het strafrecht valt de coroner op, de ambtenaar die al sinds de Middeleeuwen onnatuurlijke doodsoorzaken onderzoekt.

De Harvard Law School is bezig met de digitalisering van juridische handschriften met daarin statuten (inclusief Magna Carta) en writs, en ook zo’n 170 manor rolls. Susannah Vale maakte in 2003 een lijst van handschriften van year books.

Een belangrijke gids naar de reports in de Year Books tussen 1268 en 1535 vormt de database van David Seipp. Verder is er ook het Corpus of Historical English Law Reports 1535-1999 (CHELAR), University of Helsinki, met law reports in een versie voor taalkundig onderzoek. De uitgave uit 1802 door de Record Commission van de Taxatio Ecclesiastica Angliae et Walliae Auctoritate P. Nicholai IV, een unieke taxering van kerkelijke goederen in Engeland en Wales in de jaren 1291-1292, wordt successievelijk online toegankelijk gemaakt en opnieuw uitgegeven.

Sanctuary Seekers in England 1384-1557 is de website bij de studie van Shannon McSheffrey, Seeking Sanctuary: Crime, Mercy, and Politics in English Courts, 1400-1550 (Oxford 2017) met 1800 zaken waarin deze vorm van kerkrechtelijke bescherming vaak botste met de common law.
